Article 1: General Provisions
The seller's e-commerce webshop offers its customers the opportunity to purchase products online from its web store. These General Terms and Conditions ("Terms") apply to every order placed by a visitor to this e-commerce webshop ("Customer"). Additional terms of the Customer are excluded unless they have been accepted in advance, in writing, and expressly.
Article 2: Price
All prices are stated in euros and, unless otherwise indicated, inclusive of VAT. If delivery, reservation, or administrative costs are charged, this will be specified separately.
The price listing applies solely to the items as described in text. The accompanying photos are decorative and may contain elements not included in the price.
Article 3: Offer
Despite the utmost care taken in compiling the online catalog and e-commerce webshop, it is possible that the information offered is incomplete, contains material errors, or is not up-to-date. Clear mistakes or errors in the offer are not binding. The seller is not liable in any way for manifest material errors, typographical, or printing errors. If the Customer has specific questions regarding, for example, sizes, color, availability, delivery time, or method, we request that the Customer contact our customer service in advance.
The offer is valid while stocks last and can be adjusted or withdrawn at any time. The seller cannot be held liable for the unavailability of a product.
Article 4: Online Purchases
The Customer can choose between payment by bank card or credit card as payment methods.
The seller is entitled to refuse an order due to a serious Customer default regarding orders in which the Customer is involved.
Article 5: Delivery and Performance of the Agreement
Any visible damage and/or qualitative deficiency of an article or other deficiency in the delivery must be reported immediately by the Customer.
The risk of loss or damage passes to the Customer from the moment he (or a third party designated by him, other than the carrier) physically possesses the goods.
Orders are always processed within 5 working days (working days are Monday - Friday) unless otherwise indicated in the shipping method or due to closure for holidays or vacation periods. Closure for vacation periods is always clarified on the webshop. The standard delivery period is a maximum of 30 days, but in exceptional cases, the delivery period may be extended. An exceptional situation could be that the products are not in stock. If the delivery period is longer than 30 days due to this reason, the customer will be informed accordingly. If there is any other reason that affects and prolongs the delivery period beyond 30 days, the customer will be directly notified.
Article 6: Retention of Title
The delivered items remain the exclusive property of the seller until full payment by the Customer.
Article 7: Right of Withdrawal
The provisions of this article apply only to Customers who purchase items online in their capacity as consumers.
The consumer has the right to withdraw from the agreement within a period of 14 calendar days, unless otherwise specified, without giving reasons, provided that the right of withdrawal applies to the goods or service ordered by the customer. To exercise the right of withdrawal, the Customer must inform the seller of his decision to withdraw from the agreement by means of an unequivocal statement (e.g., in writing by post or email). The Customer must immediately return or hand over the goods after deciding to withdraw from the agreement. The direct costs of returning the goods are borne by the Customer unless otherwise agreed.
If the returned product has diminished in value in any way, the right is reserved to hold the Customer liable and claim compensation for any decrease in value. Only items that are in the original packaging, together with all accessories, instructions for use, and invoice or proof of purchase, can be returned.
In the event that the agreement involves the provision of services and if the Customer has requested that the services begin during the withdrawal period, the Customer shall pay an amount proportional to what has already been delivered at the time he informs us of the exercise of the right of withdrawal, compared to the full performance of the agreement.
Article 8: Warranty
Under the law of September 21, 2004, concerning the protection of consumers in the sale of consumer goods, the consumer has statutory rights. This statutory warranty applies from the date of delivery to the first owner. To invoke the warranty, the Customer must be able to present proof of purchase.
The (commercial and/or legal) warranty never applies to defects arising as a result of accidents, neglect, falls, use of the article contrary to its intended purpose, failure to comply with the instructions for use or manual, adjustments or modifications to the article, rough handling, poor maintenance, or any other abnormal or incorrect use.
Article 9: Sanctions for Non-Payment
Without prejudice to the exercise of other rights, in the event of non- or late payment from the date of the default, the Customer shall owe interest by operation of law and without notice on the unpaid amount. Notwithstanding the foregoing, the right is reserved to take back (in part or in full) items that have not been (fully) paid for.
Article 10: Validity - Non-Waiver
If any provision of these Terms is found to be invalid, illegal, or void, this shall in no way affect the validity, legality, and applicability of the other provisions.
The failure at any time by the seller to enforce any of the rights listed in these Terms, or to exercise any right thereof, shall never be deemed a waiver of such provision and shall never affect the validity of these rights.
Article 11: Amendment of Terms
These Terms are supplemented by other conditions explicitly referred to and the seller's general terms and conditions of sale. In the event of any conflict, these Terms shall prevail.
Article 12: Applicable Law
Belgian law applies. The courts of the Seller's domicile have jurisdiction over judicial disputes. The Seller may also refer to the ODR platform.
